Overview Regarding the Export of Plastic Scrap

The governmental agencies and the Ministry of Environment, Forest and Climate Change (MoEF&CC)encourage the export of plastic scrap. This is to regulate the increasing amount of unmanaged plastic scrap in India due to a lack of proper infrastructure or collection system.

India exports plastic scrap to 41 countries and territories. The total worth of the export is 0.52 million US dollars. The recent data on the Export of Plastic Scrap shows India's top 5 trade partners. These are mentioned in the table given below. However, the total export value of waste plastic in the top 5 countries is 0.49 million US dollars, equal to 94.23 per cent.

The permitted limit for Export of Plastic Scrap

Only certain types of plastic are listed as Export Plastic Scrap, as per the Plastic Waste Management Rules, 2016. Some of these are: -

  • Polyethylene Terephthalate (PETE)
  • High-density polyethene (HDPE)
  • Polyvinyl chloride (PVC - U)
  • Polypropylene (PP)
  • Polystyrene or Styrofoam (PS)
  • Low-density polyethene (LDPE)
  • Others

Waste Export Compliance Governing the Responsibility of Export Plastic Scrap

MoEF&CC,under the Hazardous and Other Waste (Management, Handling and Transboundary Movement) Rules, 2016, has defined Waste Export Compliance and exporters' responsibilities. These responsibilities must be fulfilled whileplanningExport plastic Scrap from India.

  1. The exportermust register through a centralised online portal under the Hazardous and Other Waste (Management, Handling and Transboundary Movement) Rules, 2016.
  2. General information like a mobile number and e-mail address with the application must be facilitated for the Export of plastic Scrap.
  3. Apart from basic information, exporters of Export plastic Scrap are also required to provide a hard copy of the prescribed documents with the applications to the MoEF.
  4. The exporters seeking to export plastic scrap must be present at the presentation before the expert committee (if required). Additionally, exporters must ensure they are there for two meetings held by the expert committee. If the exporter who wants to establish a business is absent, their authorisation will be annulled to renew, and they must file a new application.

Authorisation from the Ministry for Export of Plastic Scrap

The authorisation application for the Export of Plastic Scrap is required to be submitted with the mandatory documents listed below: -

  • Application for authorisation is to be submitted under Form 5 along with insurance cover to the MoEF&CC. For the expectedPlastic Scrap export from India, the application must be accompanied bythe mandated informed consent in movement documents from the importing country.These are documentedas prescribed under Part - A of Schedule III and VI of the Hazardous and Other Waste (Management, Handling and Transboundary Movement) Rules, 2016.
  • After the authorisation application is completed and submitted to the ministry,the registration/certificate is granted for the export of plastic scrap. Along with this, a copy of authorisation is also sent to the concerned Pollution Control Board (PCB)/State Pollution Control Board (SPCB). The person facilitating export plastic scrap needs the following documents for the same-
    • Export justification;
    • Authorised Consent to Operate under Water and Air Acts; 
    • EPR Authorisation;   
    • Insurance policy including the liability to health and environment during transit; 
    • Acknowledgement for a receipt of a copy of the application from the concerned PCB/SPCB;
    • Agreement copy between the stakeholders;
    • Copy of any authorisation issued by the MoEFCC(if applicable);

Import Export Code Registration for India

Import and Export Code (IEC) is the ten-digit code. Granted by the Ministry of Commerce, IEC is required for every export and import activity in India. IEC code is approved by the DGFT (Director-General of Foreign Trade). Also, the exporter does not additionally require to apply for IECagain or even for its renewal. The application is given online with the prescribed documents, bank details and (Digital Signature Certificate) DSC, verified by the authorities. Once the documents are submitted, the code is granted in soft copy to the business owner/exporter for the export of plastic scrap in India.

Documents Required

The Ministry of Commerce mandates the following documents required for an IEC registration.

  • Company Incorporation Certificate or partnership deed
  • Address proof
  • Copy of cancelled cheque leaf/banker certificate of the current account in the company's name

Consent Certificate

  1. CTE (Consent to Establish)is essential for establishing an export plastic scrap business in India. Exporter obtains the consent defined under Plastic Waste Management Rules before the unit is instituted as per the Air and Water (Prevention and Control of Pollution) Acts.
  1. CTO (Consent to Operate)is essential for establishing the Export Plastic Scrap business in India. Defined under the PWM Rules, the exporter obtains consent after the unit is instituted and is ready to start the export of plastic scrap as per the Air and Water (Prevention and Control of Pollution) Acts.

Along with the IEC and MoEF's certificates, other necessary certificates for export plastic scrap business that the exporter acquires are consent certificates, i.e., Consent to Establish and Consent to Operate.

The acquisition process of these certificates is regulated under the Water & Air (Prevention & Control of Pollution) Acts. It is kind of similar to each other. The process includes submitting the application form through the centralised online portal of the concerned Union Territory Pollution Control Committee or the State Pollution Control Board. The application must be submitted with the certificates/documents or licenses required under the implementation guideline of the Central Pollution Control Board(CPCB). Finally, the authorities inspect the form that is submitted.

After this, an authorised government official conducts a site inspection and frames a comprehensive report accordingly. At last, according to this, the consent certificates are granted.

Note: - While applying for Consent to Operate required for export plastic scrap business, one has to keep in mind that the authorisation process has the additional step of the site inspection. Government officials conduct the inspection.
